Introduction
RoamRoar Safaris, herein referred to as Roamroar Kenya Safaris operates the website www.roamroarkenyasafaris.com. These terms and conditions govern the use of our services, including safari tours and related travel arrangements, offered through this website. You agree to abide by these terms and conditions by accessing and using our website and services.
Definitions
- Company: RoamRoar Safaris, a registered safari operator.
- Client: The person, firm, or company contracting directly with RoamRoar Safaris for services, or any individual in the party under their booking.
- Organizer: A tour organizer, operator, company, or agent contracting with RoamRoar Safaris on behalf of clients.
General Conditions
- All bookings made with RoamRoar Safaris are subject to these terms and conditions. No alterations or additions shall be binding unless confirmed by RoamRoar Safaris in writing.
- RoamRoar Safaris acts as an intermediary between clients and third-party service providers (hotels, airlines, etc.), and any liability arising from these services lies with the respective providers.
- The Company reserves the right to modify itineraries or substitute services of equal value due to circumstances beyond its control, such as park closures, road conditions, or safety concerns.
Pricing and Payment
Price Variation
- RoamRoar Safaris reserves the right to adjust prices due to factors including but not limited to changes in currency exchange rates, government taxes, fuel prices, and supplier costs. Clients will be notified of any price increases before booking confirmation.
Deposit and Payment
- Booking Confirmation: After clients confirm their booking, they receive an invoice with all details.
- Deposit Payment: To confirm a reservation, RoamRoar Safaris requires a 25% deposit payment of the itinerary cost.
- Balance Payment: The remaining balance must be paid no later than 35 days before the tour commencement date.
- Late Payments: Failure to pay the balance by the due date may result in cancellation of the booking without refund of the deposit.
Late Bookings
- Bookings made within 35 days before departure are subject to full prepayment at the time of confirming the reservation.
Cancellation and Refund Policy
RoamRoar Safaris strives to provide exceptional experiences for our guests. However, RoamRoar Safaris understands that circumstances may arise that require changes to your travel plans. Our cancellation and refund policy is designed to address these situations while taking into account the individual policies of the hotels and lodges included in your itinerary.
Cancellation Policy
Hotel and Lodge Policies
- Cancellation fees for our safari packages are based on the individual policies of the hotels and lodges included in your itinerary. Each accommodation provider has its cancellation terms and conditions, which will be communicated to you when booking.
- RoamRoar Safaris strongly recommends reviewing these policies carefully.
Cancellation Notification:
- Should you need to cancel your safari, you must do so in writing as soon as possible.
- Notify RoamRoar Safaris of your intention to cancel by emailing info@roamroarkenyasafaris.com or by mail to [mailing address].
Refund Process
- RoamRoar Safaris will assist you in managing the necessary arrangements per the respective hotels' policies.
- The refund amount will be less transaction charges and subject to currency conversion rate changes.
- Refunds will be processed within 30 days of receipt of the cancellation notice, minus any applicable cancellation fees and administrative charges.
Insurance and Health Requirements
Travel Insurance
- RoamRoar Safaris strongly recommends that Clients obtain comprehensive travel insurance to cover medical expenses, emergency evacuation, trip cancellation, and loss or damage to personal belongings. Clients are responsible for ensuring they have adequate insurance coverage for the duration of their safari.
Health Requirements
- Clients must ensure they are aware of and comply with all health requirements and recommendations for their destination(s). RoamRoar Safaris may require Clients to provide proof of vaccinations or medical fitness as required by local authorities.
Client Responsibilities and Conduct
Client Conduct
- Clients are expected to conduct themselves in a manner that does not disrupt the enjoyment of other tour participants or cause harm or damage to property. RoamRoar Safaris reserves the right to terminate a Client's participation in a tour if their behavior is deemed detrimental to the safety or well-being of others.
Health and Safety
- Clients must follow all safety instructions provided by RoamRoar Safaris and its guides during the tour. Failure to do so may result in removal from the tour without a refund.
Complaints and Dispute Resolution
Complaints
- In the event of any issues or complaints during the tour, Clients must notify RoamRoar Safaris promptly to allow the Company the opportunity to resolve the matter. Complaints should be submitted in writing within 20 days of the tour's completion for timely review and response.
Dispute Resolution
- Any disputes arising from these terms and conditions shall be governed by the laws of Kenya and shall be subject to the exclusive jurisdiction of the courts of Kenya
Transportation
Vehicles
- The kinds of cars used for safari transportation on unpaved roads in East Africa differ from tour cars used on public roads in developed nations, and most of them lack air conditioning except for an open sunroof.
- Sliding passenger windows and a conventional design characterise the Safari 4x4 Land Cruisers that are used for overland road safaris on the major routes outside of the parks.
- Fly-in safari packages allow visitors to use open-sided safari viewing vehicles inside the wildlife parks and conservancies.
- Regular maintenance checks are performed on all safari vehicles to ensure they are in optimal condition for travel.
Roads
- Road conditions in safari areas can be unpredictable and vary with weather conditions.
- RoamRoar Safaris ensures that vehicles are suitable for the terrain and that drivers are experienced in navigating these roads.
- Due to varying road conditions, travel times between destinations may differ from those estimated in the itinerary.
- RoamRoar Safaris will make every effort to adhere to the planned schedule but cannot be held responsible for delays caused by road conditions.
Miscellaneous
Amendment of Terms
- In the event of any issues or complaints during the tour, clients must notify RoamRoar Safaris promptly to allow the company the opportunity to resolve them. RoamRoar Safaris reserves the right to amend these terms and conditions at any time. Updated terms and conditions will be posted on the Website and will apply to all bookings made after the date of amendment.atter. Complaints should be submitted in writing within 20 days of the tour's completion for timely review and response.
Severability
- If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
Waiver
- The failure of RoamRoar Safaris to enforce any provision of these terms and conditions shall not constitute a waiver of that provision or any other provisions herein.
Agreement
- These terms and conditions constitute the entire agreement between RoamRoar Safaris and the client or organizer, superseding any previous agreements or arrangements.
By booking with RoamRoar Safaris, clients and organizers acknowledge and agree to these terms and conditions. Any modifications must be made in writing and agreed upon by RoamRoar Safaris.
